EZMEDICAL – TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the EZ-Medical AI platform. By accessing EZ-Medical AI, you agree to these Terms.

1. About EZMedical

Description	Details
What EZ-Medical AI Provides	SaaS tools for clinics: scheduling, reminders, messaging, forms, intake, automations.
PHI Processing	Where PHI is processed, EZ-Medical AI acts as a Business Associate under HIPAA.
BAA	A Business Associate Agreement governs PHI obligations.

Topic	Details
Privacy Policy	Your use is governed by the EZ-Medical AI Privacy Policy.
HIPAA Compliance	EZMedical follows the Privacy Rule, Security Rule, and HITECH.
Safeguards	Administrative, technical, and physical controls protect PHI.
Your Responsibility	You must comply with HIPAA if you are a covered entity or Business Associate.

Requirement	Details
Age Requirement	Must be 18+ or supervised by a guardian in non-clinical contexts.
Legal Eligibility	You must be legally able to enter a binding agreement.
Clinical Use	No unlicensed medical practice allowed.

Your Responsibility	Details
Credentials	Maintain confidentiality of login details.
Staff Roles	Configure permissions appropriately.
Device Security	Ensure workstations and mobile devices are secured.
Account Usage	You are liable for all actions under your account.

Use the software under your subscription.	Reverse engineering, unauthorized access, malware uploads, scraping, data mining (outside permitted APIs), interfering with performance, harassment, spam, or system abuse.

Your Responsibility	Requirements
Consent	You must obtain patient consent.
Content	You are responsible for message content.
Legal Compliance	Must follow HIPAA, TCPA, CAN-SPAM.
Liability	EZMedical not liable for improper messages.

You are responsible for complying with local laws when using EZ-Medical AI outside the U.S.

You agree to indemnify EZ-Medical AI from claims resulting from misuse of the Service, violations, User Content, or third-party integrations.

All disputes will be resolved through binding arbitration.

Services are provided “AS IS” without warranties.

EZMedical is not liable for indirect or consequential damages. Liability is limited to fees paid in the last 12 months.

EZMedical may suspend or terminate accounts for violations or security risks.

These Terms + Privacy Policy + BAAs form the entire agreement.

Updates may occur with 30 days notice.
